On June 10, David Schlachter argued at the Colorado Supreme Court on behalf of contractor client Denny Construction in an important case relating to losses caused when a contractor loses its ability to obtain bonds for public works projects. Denny was awarded significant damages by a Denver jury, including damages relating to lost bonding capacity. The Court of Appeals purported to limit some of those damages. At oral argument, several Justices of the Colorado Supreme Court expressed significant disagreement with the Court of Appeals opinion.
